REQUEST FOR CONSENT OF THE LANDS AUTHORITY TO SUBMIT A DEVELOPMENT PLANNING APPLICATION IN TERMS OF ARTICLE 71 (5) of CHAPTER 552 OF THE LAWS OF MALTA.

Prerequisites

In order to complete this application you will require the following documents:

  • A scanned copy of the Applicant's ID Card or Passport.

  • A scaned copy of this declaration, duly filled and signed by the applicant.

  • Scaled Site plan 1: 2500 over the signature of a perit indicating exact property location.

  • Recent photos indicating date when these were taken.

  • Drawings of plans (scale 1:100), elevations (scale 1:50) and sections (scale 1:100) in a standard format of the existing development.

  • Any other document you may think is relevant to the application.

  • NOTE: Where possible, plans and drawings should be submitted in AutoCAD DWG format.

Please confirm acknowledgment of the following notes:

  • Should the Authority finds no objection in principle to the Development Planning Application on the site in question, the eventual clearance would be subject that:
    (a) the attached ownership declaration and attached documentation are correct;
    (b) the proposed development is in accordance with the status of government ownership;
    (c) the proposed development does not run counter to conditions under which it is let/given on emphyteusis; and
    (d) no third party rights are being infringed by proposed development.

    This clearance would also be issued without prejudice to a final decision being taken by the Lands Authority in respect of any development that is permitted by Planning Authority.

    Moreover, the eventual clearance shall not confer any rights over the government property which was not previously vested.

    The Lands Authority also reserves the right to refuse granting the necessary final clearance for any planning permit which may be issued.

    The Lands Authority is in no way to be held responsible for any expenses incurred in seeking the Planning Authority’s approval.

  • This application together with all decisions including documents pertinent to this application, including the application report containing the CEO’s recommendation, the eventual Authority’s decision together with the relative documents including the reasons for the grant of such permissions or refusal shall be made available for public inspection.

  • Should applicant feel aggrieved with the decision of the Authority, an appeal may be lodged within twenty days from the receipt of the Authority’s decision to the Administrative Review Tribunal in terms of Article 57 (1) of Chapter 563 of the Laws of Malta.
