Expression of Interest for the Engagement of Lawyers and Notaries for the Lands Authority
The Lands Authority, through this Expression of Interest (EOI), invites eligible candidates interested in being engaged in a contract for service of Lawyer and/or Notary for a task-based contract period.
The scope of the work of the engaged personnel shall be to carry out tasks such as recognitions, redemptions (including proof of title), correctory deeds, diritto di seguito, schedule of deposit, cancellation of hypotec, conversions, terminations, enforcement notification and eviction orders, judicial letters for arrears, and legal notice while all searches remain the property of the Lands Authority.
The service shall commence upon the last signature on the Service Contract.
The Consultant shall be paid a fee of €50 (excluding VAT) for every file against the submission of a VAT fiscal receipt, for the services rendered during the preceding four (4) weeks.
- Specific Objectives:
- Recognitions – This task involves the vetting of recognition applications including the deed of acquisition, the declaration causa mortis and will (if any), the deed of donation as the case may be, with the ultimate aim of issuing a recognition letter in the name of the new emphyteuta/e or tenant/s.
- Redemptions – Examining the root of title (provenance) of the property including the verification of the documents submitted. This is to be followed by the drafting of the Case Officer Report and the issuing of the redemption price. The Consultant may be required to appear as a representative of the Authority for the publication the deed.
- Correctory Deeds – Analysing the documents submitted and verifying whether the correction is required. This is followed by the drawing up of a Case Officer Report seeking approval thereof. The Consultant may be required to appear as a representative of the Authority for the publication of the deed.
- Diritto di Seguito – Examining the documents submitted in those cases where the property is going to be transferred to third parties post redemption and the transferees are still to abide by the conditions that emerge from the original emphyteutical concession and redemption scheme. The Consultant may be required to appear as a representative of the Authority for the publication of the deed.
- Schedule of Deposit and/or Redemption – The vetting of the request and verification whether the Schedule is valid i.e. all the requisites stipulated by law have been followed and whether the Lands Authority can withdraw said funds. A Case Officer Report needs to be drafted in this respect, seeking approval for said withdrawal and liaising with the Legal Procurator thereafter.
- Cancellation of Hypothec – Analysing the request and verifying documents in those cases where the property is going to be transferred to a third-party post redemption, with the intention of developing the property. A Case Officer Report needs to be drawn up seeking approval for the cancellation of hypothec, subsequent to an architects’ valuation. The Consultant may be required to appear as a Representative of the Authority for the publication of the deed.
- Conversions – proof of Title – Examining the documents submitted including the root of title and whether the applicant qualifies to convert the title of property under Chapter 158 of the Laws of Malta. A Case Officer Report needs to be drafted seeking approval. The Consultant may be required to appear as a Representative of the Authority for the publication of the deed of conversion.
- Terminations of Lease – Examining the documents at hand and verifying whether there are sufficient grounds for the termination of the lease. A Case Officer Report needs to be drawn up seeking approval of the same. This is to be followed by the issuing of a letter/judicial letter (as applicable) giving notice to the tenant of the termination of the lease.
- Enforcement Notification and Eviction Orders – Examining the request together with the verification of documents to establish whether there are sufficient grounds for the eviction of a person. A Case Officer Report is to be drafted in this respect, seeking approval of the same. This is to be followed by the issuing of a judicial letter giving notice to the addressee with a time-frame within which said eviction is to take place.
- Judicial Letters for Arrears – Examining the case at hand including verification of documents to establish whether there are sufficient grounds for the issuance of said judicial letter. A Case Officer Report is to be drawn up, seeking approval of the same.
- Legal Letters – Examining and verifying the documents to establish whether there are sufficient grounds for the issuance of a legal letter to the emphyteuta/e or tenant/s as the case may be.
N.B. – The Authority reserves the right to request the preparation of any or all of the tasks mentioned above.
- Eligibility
- Applicants shall be in possession of a valid Warrant, at the time of submission of their application.
- Disclosure of Information
- All documentation shall be deemed the property of the Lands Authority, and no one is authorised to share, disclose, or use any related information regarding the assigned tasks either for personal or non-personal purposes.

- The engagement of Lawyers and/or Notaries is at the discretion of the Selection Committee.
- The decision of the Selection Committee is final.
- Eligible candidates will be required to sit for an interview.
- The selected candidates may be required to sign a non-disclosure agreement.
