I am interested in applying for this Scheme. How do I apply?

You can apply for this scheme by submitting your application through our website www.landsauthority.org.mt / Services / Online Application Forms / GLA29 Applications shall only be accepted if submitted through our portal. No fees apply for this application

I have already submitted my application to be recognised as an emphyteuta with the authority but did not receive the official recognition letter to date. Can I apply for this scheme?

Yes you can apply for this Scheme. On the designated online form (GLA29) one can upload the relative documentation which was already submitted with your application for recognition (example : acknowledgement letter).

I am not the recognised emphyteuta with the Lands Authority on my property and I have never submitted an application to date. Can I apply?

Yes you may apply for this Scheme by filling in the Un-Recognised Tenancy Details Section on the same online application.

The temporary ground rent imposed on my property expired before the effective date of this legal notice. Can I apply?

You can apply for an extention of a 50 year term within 3 years from the effective date of this legal notice, that is by 13th July 2026. Applications for ground rents which expired before 14th July 2023 submitted after 13th July 2026 will not be accepted.

The temporary ground rent imposed on my property expires after 31st of December, 2030. Can I apply for this scheme?

No. This application is only applicable for properties burthened by a temporary emphyteusis expiring by the 31st of December, 2030.

The temporary ground rent imposed on my property expires after the effective date of this scheme, that is 14th July 2023. Can I apply?

Yes you can submit your application prior to the expiry of the emphyteusis burthening your property, provided that the expiry date is before the 31st of December, 2030. It is important that you apply before the ground rent expires, otherwise the application will be refused.
Therefore it is important to apply before the date of expiry of the ground rent

How many years can an emphyteusis be extended through this Scheme?

Application for the extension of ground rents through this scheme is for 50 years.

I have a property burthened by a temporary emphyteusis which was granted to me through a special resolution of the House of Representatives. Can I apply?

No. Emphyteutical concessions granted by a special resolution of the House of Representatives are not eligible in this scheme.

The property in question is burthened by a temporary emphyteutical concession, granted for residential or commercial purpose, and which expired/is about to expire, and the site area exceeds 1,500m2. Can I apply?

No. This scheme does not apply to residential and commercial properties which were originally granted temporary emphyteutical concessions if the site area exceeds 1,500m2 .

The site area of the agricultural/rural land burthened by a temporary emphyteusis, which is expired/about to expire, exceeds 1,500m2. Does the scheme apply for this property?

Yes, provided that the application satisfies all other criteria established in the scheme.

The temporary ground rent burthening the rural / agricultural land I own is not in a Development Zone. Can I apply?

Yes you are eligible to apply in this scheme whereby applicant can be granted an agricultural lease following the expiry of the temporary emphyteusis.

I run a kiosk which is burthened by a temporary emphyteusis which expired/is about to expire. Can I apply?

No. This scheme is not applicable for Kiosks.

The temporary ground rent imposed on my property which is about to expire was granted following a call for tenders. Can I apply?

No. This scheme is not applicable for properties granted through public calls for tenders.

The temporary ground rent imposed on the agricultural / rural land granted to me expired/is about to expire is included in a Development Zone in accordance with the local plans approved in the Development Planning Act. Can I apply?

No. This scheme is not applicable for agriculutural/rural land which is included in a Development Zone in accordance with an approved Development Plan.

The application I submitted was not accepted by the Lands Authority. How do I submit my grievance?

Your legal adviser may submit your objection to the Lands Authority’s decision at the Administrative Review Tribunal at the Courts of Law within 20 days from the date of the refusal notice.
